GeoMapNZ – Terms & Conditions of Service and Website Use

These Terms & Conditions (“Terms”) govern all use of the GeoMapNZ website and all Services provided by GeoMapNZ.
By accepting an Estimate, engaging our Services, or using this Site, you agree to these Terms.
1. About GeoMapNZ
GeoMapNZ (“we”, “us”, “our”) provides aerial photography, mapping, orthomosaic, and related drone-based services throughout New Zealand.
“You” or “the Client” refers to any individual or organisation using our Site or engaging our Services.
2. Estimates and Acceptance
Any Estimate issued by GeoMapNZ is valid for 30 days unless stated otherwise.
An Estimate is not a binding contract until accepted in writing (including by email confirmation or purchase order).
Acceptance of an Estimate confirms agreement to these Terms.
Any changes in scope, site access, weather conditions, or Client requirements may affect cost and delivery.
3. Services and Deliverables
GeoMapNZ will provide the Services described in the accepted Estimate with reasonable skill and care.
Drone operations are weather-dependent and subject to CAA regulations and airspace approvals.
We may adjust or postpone flights if conditions are unsafe or non-compliant.
Deliverables include orthomosaics, digital imagery, or mapping data as specified in your Estimate.
4. Price and Payment
All prices are in New Zealand Dollars (NZD) and exclude GST unless stated.
Payment is due within 7 days of invoice issue.
Late payments may incur interest and administration fees.
GeoMapNZ reserves the right to withhold deliverables until full payment is received.
5. Client Responsibilities
The Client must provide safe site access, accurate information, and any required consents.
The Client must notify nearby parties or landowners if necessary to ensure safe drone operation.
GeoMapNZ is not liable for delays or additional costs arising from lack of access, inaccurate data, or non-compliance by the Client.
6. Intellectual Property
GeoMapNZ retains ownership and copyright of all raw data, source files, and flight data.
Upon full payment, the Client receives a non-exclusive licence to use final deliverables for the purpose stated in the Estimate.
Deliverables may not be sold, shared, or distributed without written permission.
We may use non-identifiable imagery for marketing or portfolio purposes unless otherwise agreed.
7. Data and File Delivery
Deliverables are provided in the agreed format (e.g., JPEG, TIFF, GeoTIFF, PDF, or similar).
GeoMapNZ is not responsible for the Client’s storage, backup, or loss of files after delivery.
8. Liability and Warranties
We guarantee reasonable skill and care in all work performed.
Except as required by the Consumer Guarantees Act 1993 or Fair Trading Act 1986, all other warranties are excluded.
The Client is responsible for maintaining their own insurance covering property, buildings, crops, vehicles, and other assets during drone operations.
By engaging our Services, the Client agrees that GeoMapNZ accepts no liability for incidental, indirect, or accidental damage that may occur on-site, including to property, structures, fencing, vehicles, or vegetation.
Any damage or loss occurring during operations is deemed the Client’s responsibility and must be managed under their own insurance cover.
Our total liability, in any event, shall not exceed the total amount paid for the relevant Service.
GeoMapNZ shall not be liable for any loss of data, profit, or business interruption.
9. Cancellation
If the Client cancels after work has begun, GeoMapNZ may charge for Services and expenses incurred to that point.
We reserve the right to cancel or delay work due to unsafe weather, regulatory changes, or equipment failure.
10. Privacy and Data Protection
We comply with the Privacy Act 2020.
Personal data (such as names, emails, addresses, or site coordinates) is collected only to provide our Services and is not shared without consent.
12. Force Majeure
Neither party is liable for delays or failures caused by events beyond their reasonable control, including extreme weather, airspace closures, or equipment failure.
13. Disputes and Governing Law
Any disputes will first be discussed in good faith and may be referred to mediation.
These Terms are governed by the laws of New Zealand, and any disputes will be heard in the New Zealand courts.
